Paternity Suit

Posted on March 28, 2010.
Paternity SuitDisputed paternity?

My court date is June I am married, but have seen my "husband" in 4 years. I have always been my maiden name. (I never changed) but when I got my papers Court they used my married name they departed earlier documents support that I completed for my ex. My baby has the same surname as me which is my maiden name. His birth certificate has no father listed.
Do you think I need to have my ex husbands complete denial of paternity? Do you think my civil courts will concidering not named on the birth certificate. Can I go out with them that they used my name ex husband?

If you have a marriage certificate, you'll be fine. Chances are the name used on the documents have been made by mistake, since most couples change their name.

They passed a law in July '06 that no matter what the birth certificate says before they make any decisions they need a DNA test.
You must call the courthouse and tell them they got your name wrong. You may have a case to fit the way you want and if it is found that, although it is simple, it can call a case of forgery. Get it straightened just in case it bites you later.

Wow, I do not know what you should do. My mother is trying to get my father to pay child support and throw his *** in jail because he has not paid child support in over a year and has not yet been arrested, her crazy. I wish I could help you, God bless

A husband is generally regarded as the father of the child of a woman, if your ex-husband will probably want to file a denial of paternity.
Want father of the child to take a DNA test, and may be reluctant to do so. If the names on court records or birth certificates are not correct, the whole may fall on a technicality.
You should try to inform the court before trial on such errors. You can probably find a lawyer at low cost through the Legal Aid Society in your community.

Since they have a bad name on the ballot this Court will or should at least raise a question about your being married. Is that your "husband" aware of the situation? If he is ready to help you, I would just like to have addressed so that nothing comes to the future. Since you are still married, he is considered the legal father.

If he is not willing to help you, I'm afraid it sounds like it could be embarrassing ... Are you ready to file for divorce? In divorce or dissolution that you could have the child delivered, which would be sure he does not end on its British Columbia.

Good luck!
